Hitting the Wall: Nike and International Labor Practices Essay

Based in Beaverton, Oregon, Nike had been a corporate success story for more than three decades. It was a sneaker company, but one armed with an inimitable attitude, phenomenal growth, and the apparent ability to dictate fashion trends to some of the world’s most influential consumer. Selling a combination of basic footwear and street-smart athleticism, Nike pushed its revenues from a 1972 level of $62,000 to a starting $49 million in just 10 years. In the 1980s and 1990s, Nike had been plagued by a series of labor incidents and public relations nightmares; underage workers in Indonesian plants, allegations of coerced overtime in China, dangerous working conditions in Vietnam. For a while, the stories had been largely confined to labor circles and activist publications, until a young female worker had died in a Nike contracting factory in 1997, the labor conditions at Nike had hit the mainstream. While the marketing of Nike’s products was based on selling a high profile fashion item to affluent Americans, the manufacture of these sneakers was based as an arms-length and often-uneasy relationship with low paid, non-American workers. Key Issues Nike’s strategy of shaving costs caused ethical dilemmas that ultimately damaged its reputation. Nike outsources all of its manufacturing. This approach has provided Nike with huge profits, from a 1972 level of $60,000 to a startling $49 million in just 10 years. Production is now globalised, with different countries concentrating on different parts of the process depending on what they are good at, or what they can do most efficiently or cheaply. Poorer countries get the less lucrative activities such as lowly paid semi-skilled or unskilled production or assembly. This approach also allows Nike to keep an arms-length arrangement with its subcontractors, stating that, it is not they who employ cheap labor, but their contracted suppliers, hence the responsibility lies with the latter. Define the Problem  Nike has a difficult situation to resolve. Its strategy to use celebrity endorsements to develop a strong brand identity had the result that Nike became by the 1990s one of the world’s best known brands, as well as a global symbol of athleticism and urban cool. This situation began to change by 1998, when currency woes in Asia along with the damage to its image resulted in Nike experiencing a loss for the first time in 13 years. This strategy resulted in Nike requiring steep wage concessions from its subcontractors to continue its intense growth patterns. Nike has always paid the lowest possible wages in Indonesia, claiming year after year that it could not afford even to pay the country’s minimum wage. Each year, Nike contractors in Indonesia refused to pay minimum wage raises of a few cents a day. Thanks to a corrupt and inefficient government, they usually got away with it. Adding to this problem was the issue of child labor. Nike went into Pakistan, knowing full well that child labor is an ages-old practice there and taking no precautions whatsoever to prevent the use of child labor in the production of its soccer balls. We have to conclude that Nike expected to profit from its Pakistani contractors’ known usage of bonded child labor. Nike further tarnished its reputation by attempting to dilute information that had come to the attention of the general public regarding its practices, resulting in a lawsuit. Mike Kasky is suing Nike, Inc. Under California laws regulating unfair competition and false advertising. Kasky claims that when an internal audit was leaked to the press that revealed illegal employment practices in Nike’s factories in China, Vietnam, and Indonesia, Nike responded by issuing to the press numerous statements it knew to be false. The California courts ruled last year that Nike’s PR effort was meant to bolster its image and improve its sales – so indeed, it did amount to advertising, and, as such, it needed to be truthful. Alternative Solutions Nike must to enforce its own Code of Conduct with its subcontractors. This Code has been amended several times, but had been very general in its listing of business practices. Its current version stipulates many requirements that we take for granted, one of which is that a subcontractor certifies that it pays at least the minimum total compensation required by local law, including all mandated wages, allowances and benefits. Another option for Nike would be to contract with a U. S. shoe manufacturer. Although the benefit of having its suppliers overseas has been the low prices for the finished goods, Nike would gain an advantage by providing work for the people at home. Made in USA labels are very important to many Americans. Also, the combination of job creation and openness to providing equitable wages and benefits for its workers as required in this country could reduce the uproar about its labor practices, especially among the youth. In addition, Nike could incorporate at least one factory into a tourist attraction, providing visitors with the opportunity to tour the plant, learn the history of the company, and become more familiar with the products Nike produces, thus developing more customer loyalty. A third option for Nike would be to both enforce its Code of Conduct and invest at a high level in the countries where it has factories, and highly advertise those efforts. Regarding to Nike’s web site, since 1997, Nike, with help from several of its key partners, has supported micro-enterprise ventures in Asia, playing a small but significant and direct role in building and expanding the number of locally-owned businesses in mostly rural areas throughout the region. Nike has funded micro loans and provided technical assistance in Thailand, Vietnam and Indonesia, working with the Population and Community Development Association (PDA), Vietnamese Women’s Union and Opportunity International, respectively. The press has given faces to the people who have been affected by Nike’s contractors’ exploitation. Nike must rectify the damages by giving faces to the people who have been affected in a positive way by the loans and other assistance given to the local populations. This, coupled with Nike’s firm stance on the treatment of those making its goods, would help regain its lost positive image. In addition, this option would forge a stronger relationship with the countries where the factories producing Nike’s products are located. It would also help Nike’s subcontractors to entice and retain the best local employees, thus ensuring higher quality products. Selected Solutions to The Problem This change in how Nike will handle its operations has significant drawbacks. Closely adhering to its Code of Conduct will be very expensive for Nike. Nike’s success has been heavily driven by the aggressive stance it has taken on labor costs. In addition, Nike’s subcontractors have used the freedom given to them to provide Nike the labor expense level they expect while also allowing themselves to profit as well. Nike will now be monitoring their subcontractors’ workplaces and wage practices, which will place a strain on their relationship. This new focus for Nike will require the company to divert some of its attention from its main marketing focus to supervise the overseas operations. Expected Results An immediate benefit of this decision would be the good press it would generate that Nike would be willing to put pressure on its suppliers so that the people who produce its goods are treated fairly. Another benefit would be to align Nike’s suppliers’ actions with Nike’s vision as listed on its web site www. nike. com to bring inspiration and innovation to every athlete in the world†. This would include those employed by Nike because the company considers all people to be athletes. A third benefit would be to prevent work stoppage strikes that had previously affected the company in Indonesia. Positive and Negative Results This option would require Nike to make a major shift in its focus from having a limited, long-distance relationship with subcontractors to playing a more active role in the manufacture of its products due to the proximity of its suppliers. This significant change in how Nike does business would be very expensive, both in terms of the financial outlay and use of personnel. It would require a more direct involvement of the company in a portion of the business in which it has no first-hand experience, which would entail a considerable learning curve. This would result in major upheaval for the company, and a loss of confidence by investors. Nike would also lose the competitive edge of its competitors who have lower foreign wages. To reinstate the Nike image back to its earlier prominence, Nike would be wise to pursue the option to enforce its Code of Conduct, and invest in the countries in which its factories are located. The Code of Conduct should require unannounced audits of Nike’s factories at random, frequent time intervals to ensure compliance to rules and regulations. Equipment should be inspected to meet higher safety standards than would be required in the host country. For example, if the factory is located in Indonesia, the equipment should be inspected to be compliant to United States’ Occupational Safety and Health Association (OSHA) safety standards. Doing so is above-and-beyond what may be considered reasonable† and should shed positive light on Nike’s effort. In addition, hiring documentation should be verified in the audits to assure that workers are of the appropriate age, and that children are not placed into the workforce. Subcontractors would be trained in cultural awareness and required to maintain consistent and reasonable management practices. This approach would be expensive for Nike. The company will also have to expend more energy to both monitor the manufacturing facilities and determine which small businesses to support, diverting its attention from the company’s primary focus of marketing its products and making a profit. In addition, making investments in other countries will help Nike relate in more personal ways to their local environments. This will make it more difficult for Nike to direct its subcontractors to move to another country when local labor wages have become too expensive. However, there would probably be no lack of interest if movement to new countries became necessary with Nike’s products so well known. It would ultimately hinder the company’s ability to be competitive with the other shoe manufacturers who use Indonesian labor.

This becomes a major disadvantage because as a result of vertical integration, fixed costs sharply become so high that in times of slumps in demand, a fall in production might lead to a greater rise in per unit fixed costs rather than variable costs. Such a scenario makes realisation of breakeven point near difficult. Question 1b It is suggested that vertical integration decreases costs, but when it is viewed from the organizational point of view, vertical integration leads to higher cost in terms of managing different new organizational departments and also, backwards integration tends to reduce efficiencies of suppliers by eliminating competition, thereby increasing costs. When a firm decides over vertical integration, it invests significantly in terms of investments in the organizational process. These inve stments arise out of forward and backward integration and are done on acquiring firms. Such costs are capital expenses. Huge expenses made during integration reduce a firm’s capability to stretch production capacity at least for some period of time. In an unpredictable market environment, such inflexibility can be quite serious and might lead to loss of market share altogether. During the process of integration, a firm invests in high cost machines which are necessary to carry out production activities of the acquired firm. In the slump demand scenario, the machine might not be utilised to the fullest or utilised at all. However, the acquiring firm has made expenses for the machine and the costs of which shall get added to per unit produce. Variable costs, on the other hand, are incurred per unit of good produced and can be reduced during slack in demand. Additionally, such costs cannot be shared with the consumer owing to competition. But studies such as Chiang (2009) indicate that accountability pressure, which is defined as the â€Å"threat of sanctions on low-performing schools,† is not an effective tool when schools are able to manipulate the accountability system. Referencing claims like those made by Swanson (2003), Chiang (2009) argues that accountability systems within schools properly constructed and maintained make educational reforms more likely to generate test score gains. So, even if in fact American secondary schools are failing their students in terms of the students’ long-term benefits, improved accountability systems within schools will lessen the impact of environmental circumstances that decrease student performance. Great Expectations Essay Discuss the variety of influences to which Pip is exposed during the course of Great Expectations as he approaches adult-hood, and the ways in which the readers opinion of Pips character might alter as the story develops. Charles dickens is one of the worlds best-loved writers, and Great Expectations may be one of his most autobiographical works. The Narrator of Great Expectations, Pip, is in contrast, a man of many faults, who hides none of them from the reader. If Pip is a self-portrait, Dickens must have been a reservoir of inferiority complexes, guilt and share. Many other aspects of Great Expectations are autobiographical too. Although Dickens wasnt an orphan as Pip is but he may have well felt like one. Dickens mother apparently was a careless housekeeper. Pips sister who a few times mentions that she brought him up by hand, keeps a spotless house but she doesnt know how to make it a home. In her mind, the sole ingredients of child rearing are a firm beating and a dose of tar-water. It could be that maybe she is deliberately cruel, or maybe she has just mistaken notions of how to run a family. Pips childhood wasnt so great and as a reader will find out that he doesnt have a good perspective on Mrs. Joe. This can be any more than children do on the adults closest to them: And where the deuce ha you been? was Mrs. Joes Christmas salutation, when I and my conscience showed ourselves. (Pg. 22) When Dickens was working in the blacking warehouse at the age of twelve he was lighten up as Pip was being lighten up when he was an apprentice to Joe as a blacksmith. While Pip the narrator recognises Joes goodness, Pip as a character continues to go on treating him badly. There is a point in the story when the reader will observe that Joe forgives Pip for his behaviour. Later on Pip keeps on being a snob and for Joe its something he has to live for. Joe shows a lot of love and affection for Pip: But I did mind you Pip, he returned with tender simplicity Dont cry, old chap! (Pg. 48) Joe has a very neutral relationship with Pip although he seems to find it really hard and struggles to guide Pip and try to follow Joes example of goodness. He appears to be often weak; he lets himself be defeated by Mrs. Joe, Pumblechook and even Miss Havisham. This could be why Pip seems to dislike Joe, as he gets older. Also seeing as Pip isnt consciously virtuous, it becomes difficult for Joe to attempt to teach him. Pip is seriously disgusted with Pumblechook throughout the whole book. When as a boy, he instinctively dislikes the way Pumblechook moralises and lords it over the family. I believe it is at this point where Pips snobbish behaviour may have sharpened due to the original circle of changes and I think Pumblechook patronising and insulting Pip at the same time has given him the snobbish character: But I dont mean in that form, or, returned Mr. Pumblechook, who had an objection to being interrupted Not bringing up by hand then. Not a bit of it! (Pg. 27) At the beginning of the story in a vivid scene, Magwitch appears to be a threatening, violent character to Pip. The reader can recognise at the same time that Pip does not know that Magwitch is a big, cold, hungry and desolate. When Pip lives at the forge in the marshes the setting has influenced him. It is a gloomy spooky area with convicts. It seems that it all leads to death and punishment i. e. Mrs.Joes beating and tar-water. When it comes to Magwitch appearing from a graveyard he is like a zombie. He becomes dead when the reader carries on to read the story because Pip forgets about him and Magwitch disappears for a long while. During that time of his absence Pip then catches to encounter Miss Havisham. When Magwitch does come into sight once again when Pip is in London, Pip is looking at a much more altered version of Magwitch. At this time Magwtichs importance to Pip grows even larger as the reader will discover about Magwitch and the affect of his money to Pip. Now because of this Magwitch turns out to be a similar yet a much useful character in Pips life. Also the relationship between Pip and Magwitch strengthens and Pip commences into showing devoted attention to him. Even later on Pip is interested in almost everything that Magwitch offers to attempt to say to him. He is willing to listen to him and he becomes sympathetic towards him. When Magwitch is on the deathbed Pip is telling the story of Estella and explaining how much he loves her to him. He tries to make him happy. Dickens piles on the details about Miss Havisham, it is like as it if she irresistibly fascinates him. The more he describes her, the more intensely she stands out, looming as a weird, powerful image colouring the mood of the entire book: Look at me, said Miss Havisham. You are not afraid of a woman who and very sorry I cant play just now. (Pg. 58-59) Pip is influenced by Miss Havisham in a way to love Estella and thus he is convinced by her to love Estella even through the toughest situations. He gains to be confident with her but its strange because he can list Estellas main faults- proud, selfish, cold, cruel and unloving: Love her, love her, love her! If she favours you, love her giving up your whole heart and soul to be smiter- as I did (Pg. 240) Miss Havisham is very unpredictable and it could be why that I reckon Pip most frequently misunderstands her influences to him. She can be pretty random and she can say random, embarrassing, issuing imperious commands: Sometimes I have sick fancies, she went on, and I have a sick fancy that I want to see some playplay, play, play! (Pg. 59) Now because of her out-of-the-ordinary behaviour the reader can never tell or predict what she will be like. This can confuse Pips liking for her and then it makes the reader feel sceptical about them. The different element of Pips personality seems to be constantly in conflict. For example, when he first learns that he has expectations of a great fortune, his mind goes off in a dozen different directions- selfishness, joy, guilt, suspicion, embarrassment and fear of his own fortune. Role of Money in Inequality and Rights Jonathon James Dunn For this essay, I have been asked to describe how two of the module themes help to illustrate the role of money in society. The two themes I have chosen are inequality and rights. The idea of inequality can be applied to the subject of money to give a range of different insights. The presence or absence of inequality can be judged in relation to equality of opportunity, conditions or outcomes. Inequalities take many various forms, such as the ones based on social categories, like class, gender or age. A study by the independent think tank Inequality Briefing provides an explanation regarding the distribution of wealth within the UK. It suggests where the money should be in an ideal world, where we think it should be (based on polls) and where it is. It concludes that the actual distribution figures show that the richest 20% have 60% of all the wealth. This suggests the balance is not as fair as the majority think and emphasises the apparent inequality within UK society. * The theme of inequality and rights can also be shown concerning migrants and the right to education, with the example of the rapidly growing city of Guangzhou, the export capital of southern China. After more than 30 years of domestic migration in China, more than 10 million migrant workers are working in Guangzhou city; they are considered the backbone of Chinas export industry. Guangzhou is one of the four mega cities in China which include Shanghai, Beijing, Guangzhou, and Shenzhen.ÂÂ   In 1978, less than 20% of Chinas population lived in the cities. The growth in Chinas export industry resulted in increased urbanisation, and consequently, millions of people left rural areas ascended to Chinas cities to find employment. This was at a time when the government was looking to convert broad areas of land and employ cheap labour in order to make products and to sell those products to the world. Now for the first time in history, China is a more urban country than a rural one. Desp ite the rapid growth in Guangzhou, a significant question arises; has everyone benefited from it? With Chinas rapid urbanisation driving its growing economy, the enlarging inequalities in the cities have received widespread attention. Evidence suggests, migrants have been made to feel excluded, isolated, and have suffered discrimination while also being blamed for increasing traffic congestion and urban crimes. Many people within the city are urging for reforms towards equality. The growth of Guangzhou encourages, and enables, investigation of the impact that rapid urbanisation and a fast-changing economy has in the social world. Social inequality exists between the wealthy elite and the working poor in megacities such as Guangzhou and in this sense shows some similarities to the Inequality Briefing statistics previously mentioned, regarding the UKs wealth division. Guangzhous rapid development is the result of a mixture of globalisation, the migration of people from the countryside to the city and investment into infrastructure. To achieve this, it had to take on massive debt. The issue of rights and inequality is none more prevalent than when considering migrants who are far poorer on average than those from the City. Of an estimated 14 million people living in Guangzhou, nine million are considered as residents. The Chinese population is categorised as belonging to one of two groups urban or rural under a system called hukou. This system became a way of administering the distribution of state resources and controlling migration within the country in 1958. Under the socialist regime, people were provided with ration cards to buy food and goods at subsidised prices. Those individuals who were not resident in the place where they held their hukou status were not entitled to access these rationing cards. Migrants are only permitted to work in the cities with temporary residence permits and without an urban Hukou. This seemingly archaic system remains in place today. Although movement between the countryside and the city has become much freer, people with no hukou in the place where they live face significant difficulties accessing jobs, education, healthcare and welfare. There are even recent signs that the growth of rural migrant labour is slowing down and despite the increase in the number of migrant workers during the past decade which reached an estimated 274 million in 2014, this growth has declined from 5.5 percent in 2010 to just 1.9 per cent in 2014. * The children of rural migrants are denied access to education in the city and are only entitled to free education in their hometowns. An article in the South China Morning Post suggests Some migrant workers put in 18-hour shifts in sweatshops, others sell vegetables, sweep the streets or labour in construction sites. Often that just brings in 5,000 yuan a month- This means they cannot afford the fees children without hukou must pay to study in the city. When you consider rural migrants have provided the workforce that has enabled the city to grow and prosper are not entitled to the same benefits as those who have lived in the city for all of their lives, a striking example of inequality emerges, especially as Ganzhou has particularly relied on the movement of these people from the countryside to the town. Being a full member of the UN, China are duty bound to guarantee all humans a minimum standard of rights.* It could certainly be argued that children of migrants face unnecessary ha rdship in accessing education, which could be against their human rights. Without a doubt, its been difficult for the government to maintain equity during this growth period. The rising social inequality experienced by Chinese migrant workers in the Guangzhou is worrying. The governments comprise a strategy which should aim to balance economic growth and social equality and consider removing or altering the hukou system. Punishing billions of people for the acts of one is not only inherently unfair; but also opposes other Bible verses such as: Deut. 24:16 â€Å"The fathers shall not be put to death for the children, neither shall the children be put t o death for the fathers every man shall be put to death for his own sin.† That verse says that you won’t be punished for somebody else’s sin. Also in Ezek. 18:20 states, â€Å" The soul that sinneth, it shall die. The son shall not bear the iniquity of the father, neither shall the father bear the iniquity of the son: the righteousness of the righteous shall be upon him, and the wickedness of the wicked shall be upon him.† That verse also says that when you sin you will be the one punished, not somebody else for your sin. Art on Brown vs. Board Education Supreme Court decision :: Art Exhibit Race

Fifty years ago the state of our beautiful nation was quite different. The United States were not very united at all. Fifty years ago a court decision marked a change in society that Americans will experience forever. The Brown vs. Board Supreme Court decision gave the old ?separate but equal? laws the boot. It marked the start of integration of public schools and universities. The process was not a smooth one to say the least, yet American society as it stands today is a far more equal because of it. However close we may be to equal it still is not yet equal. Artists of late have been expressing their view of American culture in many different ways. A particular group of artists calls themselves Social Studies more than likely referring to their portrayal of American social issues. At Krannert Art Museum this year Social Studies put out their third exhibit featuring eight artists? works that provoke viewers to reflect on issues of identity, tolerance, equal rights, and integration as they apply to education now. When I walked in to the exhibit I noticed a very interesting portrait to begin with. It was five separate portraits of two women, one white, one black, both attempting to sit in the same chair. The title of the work was Plessy vs. Ferguson, in memory of the Supreme Court decision that made segregation legal. The separate part seemed to hold true but the equal part was far more than lacking. Most cases seemed to be that there wasn?t enough to separate hence the reason for the two women struggling over the same chair. This art took me awhile to understand because my brain had not been geared to what I was actually witnessing. It wasn?t until I sat down on a retro style couch resting on a beige shag carpet rug facing a silent movie projection. The obvious use of perspective in this art form helped me understand the side by side projection of two different family videos. One was footage from a Jewish family and the other was an African American family?s footage. Both of the videos depicted family gatherings for celebrations such as barbeques, birthday parties, trips to Disney World and religious holidays.

In general, common sense is that sixth sense or that survival intuition that has been given to every animal on earth. Therefore, common sense is literally an instinct or an advanced understanding about one’s surroundings. Many people think of common sense as intuition or wisdom that comes from living a life that exposes one to many different experiences and circumstances. On the other hand, book sense can be derived from the same experiences and circumstances as common sense, but there is a difference. A college education comprises of other people’s insights, wisdom, and intuition about the world and how things work in this world. Many people believe that college is not for everyone. They believe that knowing and learning about life cannot be gained by reading books. In the meantime, there are many people who believe that college does prepare students for the real world. They believe college offers students valuable tools that will equip them for the real world. For instance, open classrooms where students can engage in stimulating conversations prepare students for professions that pay people who can think fast and come up with creative ideas for their companies. Moreover, professors assign homework, exams, and papers to stimulate thinking and prepare students for deadlines and job assignments. However, college may prepare students for the professional world, but does it really prepare students for the real world. They have more than 3 branches in the Dhaka city, even some of them has outside of Dhaka. 4. Their ROI is surely better, and they earn good amount of profits. 5. They placed their shops in the suitable places where people can comfortably access. 6. The most important factor is that, they have a very strong brand image, for eg: Persona. If we have to sustain in the market and create a brand image of our own, then we must do whatever our competitors are doing and try to do better than them.Our competitors are strong and popular among the people, but we are also determined to be like them and within few years, we will be at the same shoulder height.
